SKYNET INTERNET RESIDENTIAL FIBER INTERNET SERVICE TERMS & CONDITIONS
Applies to: Residential customers ordering online for service at a Texas residence
IMPORTANT NOTICE ABOUT DISPUTE RESOLUTION: These Terms include (a) a binding arbitration agreement (unless you opt out, if offered), and (b) a class action waiver. Please read the section titled “Dispute Resolution; Arbitration; Class Action Waiver” carefully.
Agreement to Terms; Clickwrap Acceptance
- Binding Agreement.These Residential Fiber Internet Service Terms & Conditions (“Terms”) govern your purchase and use of Skynet Internet residential fiber internet service (“Service”) provided by Skynet Country (“Skynet,” “we,” “us,” “our”) to you (“Customer,” “you,” “your”) at your service address in Texas (“Service Address”).
- Clickwrap Acceptance.By clicking an “I Agree,” “Place Order,” “Start Service,” or similar button, or by otherwise electronically accepting these Terms, you agree to be legally bound by these Terms and acknowledge that you have read and understand them.
- Order Summary Controls Pricing/Plan Details.Your plan name, term, monthly price, installation charges, equipment charges (if any), and other offer‑specific details shown at checkout (“Order Summary”) are incorporated into and part of these Terms. If a conflict exists between the Order Summary and these Terms on a plan‑specific item, the Order Summary controls for that item.
- Additional Policies Incorporated.The following are incorporated by reference: (a) our Refund & Cancellation Policy; (b) our Privacy Policy; and (c) our Acceptable Use Policy (included below). Where Service is delivered over an underlying network partner’s facilities, certain usage/equipment requirements may be imposed by the underlying network partner and are incorporated as “Network Partner Requirements” when disclosed to you in writing or at checkout.
Service Description; Network Partner
- What We Provide.The Service provides residential broadband internet access at the Service Address, subject to network availability, technical feasibility, and your compliance with these Terms.
- Network Partner Delivery.Service may be delivered using facilities, equipment, and/or wholesale/partner arrangements involving third‑party network providers (including AT&T). Where applicable, you agree to comply with Network Partner Requirements (including equipment location/return rules, network management practices, and prohibited uses) to the extent disclosed to you.
- No Guaranteed Speeds.Advertised/typical speeds are estimates and may vary based on factors including your in‑home network, Wi‑Fi conditions, device capabilities, wiring, congestion, and network events. Unless the Order Summary expressly states otherwise, the Service is provided on a best‑efforts basis.
Eligibility; Enrollment; Verification
- You must (a) be at least 18 years old, (b) be able to form a binding contract, and (c) order Service for a residential location in Texas that we determine is serviceable.
- Identity/Address Verification.We may require verification of your identity and Service Address, and may use commercially reasonable methods to validate information you provide. You agree to provide accurate and complete information and to update it promptly.
- Credit Review; Deposits.To the extent permitted by law, we may perform a credit review and/or require a refundable deposit or other security for payment obligations. If a deposit is required, the amount, refund conditions, and timing will be disclosed before you are charged.
Term; Auto‑Renewal; Early Termination
- Initial Term.Unless the Order Summary states a different term, your initial service commitment is twelve (12) months beginning on the Service activation date (“Initial Term”).
- Auto‑Renewal.At the end of the Initial Term, your Service will automatically renew for successive twelve (12) month renewal terms (each, a “Renewal Term”) unless you cancel before renewal as described below.
- Renewal Pricing.Unless prohibited by law, renewal will occur at our then‑current monthly rate for your plan (plus applicable taxes/fees), unless you select a different offer before renewal. We will provide your renewal rate in a renewal notice if required by law or as a customer‑friendly practice.
- How to Avoid Auto‑Renewal.You may prevent auto‑renewal by canceling your Service through one of the cancellation methods described in these Terms (and as shown in your online account) before the end of the then‑current term. If you cancel after a renewal has processed, cancellation will be effective at the end of your then‑current billing cycle, and no prorated refunds will be provided unless required by law.
- Early Termination Fee.If you cancel Service before the end of the Initial Term or a Renewal Term, we may charge an early termination fee (“ETF”) if disclosed in your Order Summary. If an ETF applies, the Order Summary will state the ETF amount and calculation method (for example: a flat fee; or a declining fee based on months remaining). We recommend using a declining, pro‑consumer ETF model that is easy to calculate and disclose.
Billing; Pricing; Taxes and Fees; Proration
- Billing Frequency.Unless otherwise stated in the Order Summary, Service is billed monthly in advance.
- Payment Processor.We may use third‑party payment processors (for example, Stripe) to process payments. You authorize us and our payment processors to charge your selected payment method for amounts you owe under these Terms.
- Taxes and Government‑Imposed Charges.You are responsible for applicable taxes and government‑imposed charges (if any), which may vary by jurisdiction and may change over time.
- Other Fees.Installation charges, professional service charges, equipment charges, late fees, failed‑payment fees, restoral/reconnection fees, and non‑return/damage fees may apply if disclosed in advance, the Order Summary, a posted fee schedule, or your invoice.
- If Service begins mid‑billing cycle, we may prorate the first month’s Service charge (or bill a full month beginning on activation, depending on what is disclosed at checkout). Except where required by law or described as a refund in our Refund & Cancellation Policy, we do not provide prorated refunds for partial months.
- Billing Errors.If you believe you were billed incorrectly, you must notify us promptly (and in any event within the time limits stated in our Refund & Cancellation Policy). We may request information to investigate; verified errors will be corrected as described in that policy.
Payment Methods; Late Payments; Suspension for Non‑Payment
- Accepted Payment Methods.We may accept credit/debit cards, ACH, and/or other payment methods as presented at checkout.
- Recurring Charges Authorization.By enrolling, you authorize recurring charges consistent with your plan until you cancel and all amounts owed are paid.
- Late Payments.If a payment is not received by the due date, we may (a) assess a late fee (if disclosed), (b) suspend Service, and/or (c) terminate Service for non‑payment.
- Service Suspension; Restoral Fee.If Service is suspended for non‑payment or other reasons permitted by these Terms, a restoral/reconnection fee may apply if disclosed.
- If your account becomes delinquent, we may use a third‑party collections agency and you remain responsible for amounts owed.
Installation; Access; Equipment; Returns
- Installation Appointment.Professional installation may be required. You agree to provide safe access to the Service Address and necessary areas (including utility entry points) and to have an adult (18+) present for installation and acceptance.
- Inside Wiring and Customer Premises Conditions.We may determine that existing in‑home wiring, power outlets, or environmental conditions are insufficient. Additional work may be required at additional cost if disclosed and approved.
- Equipment Provided.Service may require customer premises equipment such as an optical network terminal, gateway/router, or other hardware (“Equipment”). Equipment may be (a) owned by Skynet, (b) owned by a network partner, (c) leased to you, or (d) sold to you—depending on your plan and the installation. The Order Summary and/or installation documentation will identify applicable Equipment charges and ownership status.
- Care of Equipment.You must use reasonable care, keep Equipment in good condition, and not relocate, open, modify, or tamper with Equipment except as we authorize.
- Equipment Returns.If you terminate Service or if we request return of Equipment, you must return it by the deadline and method we specify. If Equipment is not returned on time or is returned damaged beyond ordinary wear‑and‑tear, you agree to pay the applicable non‑return/damage fee or replacement cost.
- Network Partner Equipment Return Rules.If any Equipment is owned by a network partner, you agree to comply with that partner’s equipment return rules (which may include a specific return deadline and non‑return fees) if disclosed to you.
- No Lien; No Resale.You obtain no ownership right in leased or partner‑owned Equipment and may not sell, pledge, or encumber it.
Maintenance; Service Interruptions; Network Management
- Planned Maintenance.We (and/or our network partners) may perform maintenance that temporarily affects Service. We will attempt to provide notice for planned maintenance when practicable.
- Outages and Interruptions.Service may be interrupted by factors including weather, power outages, third‑party failures, equipment failures, construction damage, or access limitations.
- Network Management.We and/or network partners may apply reasonable network management practices to protect the network, comply with law, mitigate abuse, and maintain service quality.
Acceptable Use Policy
- You may use the Service only for lawful, residential purposes consistent with these Terms.
- Prohibited Uses.You may not (and may not allow others to) use the Service to:
- violate any law, regulation, or court order;
- infringe intellectual property rights;
- transmit malware, engage in phishing, credential theft, or unauthorized access;
- operate or distribute botnets, spam, or bulk unsolicited messaging;
- interfere with or degrade the network, including excessive or abnormal traffic patterns that materially impair others’ service;
- resell the Service or provide it to others outside the Service Address without our written consent;
- use the Service to threaten, harass, or abuse others.
- We may investigate suspected violations and may suspend or terminate Service (with or without notice depending on severity) to protect the network, other customers, or to comply with legal obligations.
Customer Responsibilities
- Account Security.You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- Home Network Security.You are responsible for securing your devices and in‑home network, including Wi‑Fi password management, device updates, and antivirus/security hygiene.
- Third‑Party Content/Services.We are not responsible for third‑party content, websites, applications, or services accessed using the Service.
Privacy; Data Collection; Consumer Rights; CPNI
- Privacy Policy.Our data practices are described in our Privacy Policy. By using Service, you acknowledge that we will collect, use, and share data as described there (including sharing with service providers and network partners as needed to provide Service, bill, support, and protect the network).
- Texas Consumer Privacy Rights.If applicable, Texas residents may have statutory rights regarding personal data. We provide a method for submitting requests and will respond within statutory timeframes as described in our Privacy Policy.
- If we are deemed a “telecommunications carrier” for any portion of services or if CPNI rules otherwise apply, we will handle customer proprietary network information consistent with applicable law and will provide required notices and choices.
Notices; Communications Consent; Electronic Delivery
- How We Provide Notices.We may provide notices by email, text message, posting in your online account, postal mail, or other reasonable methods. Notices are effective when sent or posted.
- Service‑Related Communications Consent.You consent to receive service‑related communications (billing, outages, security, installation scheduling, support) via the contact methods you provide.
- Marketing Communications (Optional).If you opt in, we may send marketing communications. You may opt out at any time using the method provided in the message or by contacting support. Opting out of marketing does not affect service‑related notices.
- Electronic Signatures; E‑SIGN Consent.You consent to the use of electronic signatures and the electronic delivery of disclosures and records related to these Terms and your Service, except where you withdraw consent as permitted by law.
Cancellation by Customer; Cancellation by Skynet
- How to Cancel.You may cancel by (a) using the cancellation feature in your online account (if available), (b) emailing customer support, or (c) calling customer support, as listed in the Contact section below.
- To avoid being charged for a new billing cycle, you must submit a cancellation request before the cutoff disclosed in your Refund & Cancellation Policy or in your account portal. Cancellation typically becomes effective at the end of your current billing cycle unless otherwise required by law.
- Skynet Right to Suspend/Terminate.We may suspend or terminate Service for: non‑payment; violation of these Terms; fraud; threats/abuse toward staff; legal or regulatory requirements; network protection; or if Service becomes unavailable due to loss of access to facilities, rights‑of‑way, building permissions, or capacity/technical limitations beyond our reasonable control.
- Effect of Termination.Upon termination, you remain responsible for amounts owed, including any ETF and any Equipment non‑return/damage fees.
Emergency Services Limitations
- Not a Phone Service.Unless your Order Summary expressly includes voice service, the Service is not a replacement for traditional telephone service and does not provide 911/E911 calling.
- Power Dependence.Service and in‑home Equipment generally require electrical power. During power outages, Service may not function unless you have backup power.
Disclaimers of Warranties
- Service Provided “AS IS.”To the maximum extent permitted by law, Service and Equipment are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.
- No Guarantee of Uninterrupted Service.We do not warrant that Service will be uninterrupted, error‑free, or free from security incidents.
Limitation of Liability
- Damages Exclusion.To the maximum extent permitted by law, neither Skynet nor its affiliates, suppliers, or network partners will be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, loss of data, loss of goodwill, or service interruption damages) arising from or related to Service.
- Liability Cap.To the maximum extent permitted by law, Skynet’s total liability for claims arising from or related to Service will not exceed the total amount you paid to Skynet for Service during the three (3) months before the event giving rise to the claim.
- Nothing in these Terms limits liability that cannot be limited under law.
Indemnification
- Your Indemnity.You agree to indemnify and hold harmless Skynet and its affiliates, officers, employees, agents, suppliers, and network partners from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from (a) your use of Service, (b) violations of these Terms, or (c) infringement claims relating to content you transmit or activities you conduct using Service.
Dispute Resolution; Arbitration; Class Action Waiver
- Informal Resolution First.Before starting arbitration or litigation, you and Skynet agree to try to resolve disputes informally by contacting customer support and providing a written notice of dispute if requested.
- Binding Arbitration Election.Except for small claims matters, you and Skynet agree that disputes arising out of or relating to these Terms or Service may be resolved by binding arbitration administered by the American Arbitration Association under its consumer rules, as modified by this section.
- Small Claims Option.Either party may bring an individual claim in small claims court in the county of the Service Address, if the claim qualifies and remains in that court.
- Class Action Waiver.You and Skynet agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, representative, or private attorney general action.
- Governing Law for Arbitration Clause.The arbitration agreement is governed by the Federal Arbitration Act; otherwise, Texas law governs these Terms to the extent not preempted.
- Arbitration Location and Costs.Unless otherwise required by law, arbitration will take place in the county of your Service Address or by video/telephone. We will pay consumer arbitration filing and arbitrator fees for non‑frivolous claims up to a specified threshold (to be finalized by counsel).
- Opt‑Out (Optional).If Skynet elects to allow arbitration opt‑out, the opt‑out process and time window will be stated here and presented conspicuously at signup.
Changes to Terms; Assignment; Force Majeure
- We may update these Terms. If a change is material, we will provide notice and an effective date. Continued use of Service after the effective date constitutes acceptance, but you may cancel Service if you do not agree (subject to ETF rules disclosed at checkout).
- We may assign these Terms to an affiliate or successor in interest. You may not assign without our prior written consent.
- Force Majeure.Neither party is liable for delay or failure to perform due to events beyond reasonable control (including acts of God, severe weather, fire, war, terrorism, labor actions, supply chain failures, power outages, and failures of third‑party networks).
